Court Calls Out HHS Overreach in Denying Abortion Access

New York, NY – Today, a federal appeals court ruled that the Trump administration’s policy of denying young women in its care their right to access abortion is unconstitutional.

“The unqualified and politically motivated ideologues making decisions in the Trump administration constantly put their personal beliefs ahead of the rights and freedoms of women and families,” said Michelle Kuppersmith, director of Equity Forward. “The courts are correct to stand up against the administration’s overreach into women’s lives and its systematic effort to take away their rights.”

The case was brought by the American Civil Liberties Union after a 17-year-old migrant girl sought an abortion in 2017, drawing attention to a Department of Health and Human Services (HHS) policy of tracking and denying abortion requests from unaccompanied migrant girls. The decision, which dealt a blow to the Trump administration, affirmed a lower court ruling that allowed the suit to move forward as a class action lawsuit.
